Complaints procedure of Meijer Legal Advocatuur B.V. (pertaining to Article 6.28 of the Regulation on the Legal Profession) Chamber of Commerce 27196551
If you are dissatisfied with the quality of the services provided by Meijer
Legal Advocatuur, hereinafter “the Office,” or with the amount of the invoice, you should first submit your
objections to your lawyer, observing the following
provisions.
Article 1 Definitions
1.1. In this office complaints procedure, the following terms shall mean:
•Complaint: any written expression of dissatisfaction by or on behalf of the client
towards the lawyer or the persons working under the lawyer’s responsibility
regarding the formation and performance of an engagement agreement,
the quality of the service provision or the amount of the invoice, not being
a complaint as referred to in Section 4 of the Lawyers Act.
•Complainant: the client or their representative who makes a complaint known.
•Complaints Officer: the lawyer who is charged with handling the
complaint.
Article 2 Scope of application
2.1. This office complaints procedure applies to every agreement of
engagement between the office and the client.
2.2. Mr V.K.S. Budhu Lall is responsible for complaint handling in accordance with this
office complaints procedure.
Article 3 Objectives
This office complaints procedure aims to:
•Establish a procedure to handle clients’ complaints within a reasonable
period in a constructive manner.
•Establish a procedure to determine the causes of clients’ complaints.
•Maintain and improve existing relationships through proper
complaint handling.
•Improve the quality of service provision by means of complaint handling and complaint analysis.
Article 4 Information at the commencement of services – internal complaints procedure
4.1. This office complaints procedure has been made public via the office website. The
lawyer points out to the client, when entering into the engagement agreement, in the
engagement confirmation and general terms and conditions that the office applies an
office complaints procedure and that it applies to the
service provision.
4.2. Mr V.K.S. Budhu Lall ensures that the complaint is forwarded to
the complaints officer referred to hereinafter in Article 6.2.
4.3. The complaints officer informs the person against whom the complaint has been made and
gives the complainant and the person against whom the complaint has been made the opportunity to
provide an explanation
of the complaint.
4.4. The person against whom the complaint has been made attempts, together with the client, to reach a solution
either with or without the intervention of the complaints officer.”
4.5. The complaints officer handles the complaint within four weeks after receipt
of the complaint, or informs the complainant, stating reasons,
of a deviation from this period, indicating the period within which an opinion on the complaint will nevertheless be given.
4.6. The complaints officer informs the complainant and the person against whom the complaint has been made
in writing of the opinion on the merits of the complaint, whether or not
accompanied by recommendations.
4.7. If the complaint has been handled to the satisfaction of the parties, the complainant, the
complaints officer and the person against whom the complaint has been made sign the opinion on the
merits of the complaint.
Article 5 Confidentiality and free complaint handling
5.1. The complaints officer and the person against whom the complaint has been made observe confidentiality in handling the
complaint.
5.2. The complainant does not owe any compensation for the costs of handling
the complaint.
Article 6 Responsibilities
6.1. The complaints officer is responsible for the timely handling of the
complaint.
6.2. The complaints officer is mr drs. A.J.F. Gonesh, having an office at 2548
BM The Hague at Laan van Wateringse Veld 707 at the offices of Gonesh
Advocatuur.
6.3. The person against whom the complaint has been made keeps the complaints officer informed about
any contact and a possible solution.
6.4. The complaints officer keeps the complainant informed about the handling of
the complaint.
6.5. The complaints officer maintains the complaint file.
Article 7 Complaint registration
7.1. The complaints officer registers the complaint, including the subject of the complaint.
7.2. A complaint may be divided into several subjects.
7.3. The complaints officer periodically reports on the handling of the
complaints and makes recommendations to prevent new complaints, as well as to
improve procedures.
7.4. At least once a year, the reports and the recommendations are discussed at the
office and submitted for decision-making.
